Study of rights and obligations of contracting parties in engineering contracts in Bangladesh

Abstract

Th,S project introduces the basics of conlnu;ts related to engineering works and services. The proces> of ~onlrac1ing works is described to give an i<.ka how the contract i8SUC, arc framed in the pro~ess. The work dc~rihcs the relationship and interfaces of engineering and law, defmition and meaning of ~ontract, types of ~onlract<;,and prerequisites to the formalion of 3 valid contract, interpretation of contract and perlormance or breach of contract. This project also deals with the project processing pnxedure in Engineering Contract in Dangl~desh induding formulation, appraisal, and approval Ill[ projects of ditTeren! sizes \vith flow diagram. 11also deal, with processing of technical assistance project and describes organizations like National Economic Council, Executi\'e Committee of the National Economic Council, Project Evahmlion Committcc and Departmental Project Evahlation Committcc. It al~o dcals the model Condition:, nI' Contract, in which it tries to distinguish between two typc~ of Contract i.e. "Geuer-Il Conditions of Contract" and "Conditions of Panicular Application" and describes all isstles iu General Conditions 0 f Contract. Finally, some important contract l~sues from model contracts of FlOle guideline, World Hank guidelinc and llangladesh Fonn NO.2911 are analyzed and thc rights and obligation8 or Contractor and Employer are presented.
